Access prohibition on the techniques of medically assisted reproduction for fertile couples who are carriers of genetic diseases is repealed: from what is known, the Constitutional Court declared contrary to the law this provision of the Law 40/2004 and the prohibition of access to preimplantation diagnosis.

We should expect the publication of reasons for this decision in order to be understood from what perspective the regulation prohibiting access to medically assisted reproduction in these couples was deemed unconstitutional. The case was heard on April 14th, 2014, after referral from the Court of Rome, with two different decisions, in relation to  two proceedings commenced by couples that were not permitted by assisted reproduction centers  to use the method of preimplantation diagnosis, despite that they were healthy carriers of genetic diseases. Filomena Gallo, one of the attorneys of the interested couples and secretary of the association «Luca Coscioni» for freedom in scientific research, explains: "the Court declared as unconstitutional the provision prohibiting assisted reproduction in fertile couples - carriers of genetic diseases. I express my joy and satisfaction. We wanted such a decision, which would respect the rights of couples seeking access to health services in order to respect their right to health and the principle of equality. " Satisfaction expressed by the Senator of the Democratic Party Emilia De Biasi, president of the Committee on Health of the Senate: "this is another item of good news. We will study carefully the reasoning of the Constitutional Court, which gave another blow to an unjust law, because, I repeat, that Law 40 is an unjust law. "
